A comment on Outrageous hospital billings.

I'm an accountant in the construction industry. My husband was hospitalized for 108 days. During this time I started to notice the insurance company was being billed for things they shouldn't pay for. Like mistakes the hospital made that resulted in more expensive treatment (I just can't call it 'care'). Whenever I saw the case manager for the insurance company I had a list for her. The insurance company shouldn't pay for this or that. She always brushed me off and said they have auditors. Then I started to notice supplies were getting billed to his room, supplies he couldn't use. For example Chevy parts for a Ford product. I came home with cases and cases of unused supplies. At one time I saw a "special" mattress cover on the nurses' station, it had my husband's room billing sticker on it. I never saw it again and it was never used on my husband. I kept telling the case manager but she always blew me off. Insurance companies carry a lot of blame for this mess. They don't care, they just keep passing costs along. I never actually saw my husband's bills, except for a few that were mistakenly sent to him to pay. I've always been curious about them, though.

Wow, those numbers, even in the middle, at staggering. The savings are there, if people are serious about heath care solutions. This should be the focus of the speeches that the Senate floor is seeing. But, that would require honesty and not obstructionists.

Norris, I couldn't agree more with your comments. Another way to limit jury awards might be with the expanded use of mediation in potential malpractice suits. In mediation, which could be either before or after suit is filed, the parties get together with a neutral mediator to see if they could come up with a solution acceptable to both parties.

Unlike a jury trial in which the jury either finds for or against the defendant doctor, and then sets the damages if they find for the patient, the parties to the mediation try to come up with a "win/win" solution. This could be setting up a life care plan for the patient in exchange for releasing the doctor. More importantly, and possible more effective, since the mediation process is confidential the agreement could even include an apology from the doctor where mistakes were made and/or a change in procedures to prevent future mistakes.

Doctors, lawyers and patients need to start working together instead of fighting, which in the ultimate scheme only profits the insurance companies. We always hear of doctors being forced out of practice because of high medical malpractice insurance (a claim I do not believe) but I have never heard of a medical malpractice insurance company going out of business because their policies were too cheap.

Many of us have always believed that greed is one of the factors that make our healthcare system the most expensive in the world.. Government has a place in keeping businesses…lawyers, drug companies, doctors, insurance companies…from making excessive profits off of people who can least afford it.

Even Republicans are starting to get behind the concept that government intervention on behalf of consumers is not only necessary…it is also good.

If we can put arbitrary caps on jury awards, we can put those same caps on the profits that drug companies, hospitals, doctors and insurance companies make.

Tort reform in itself will only save our 2 trillion dollar a year healthcare system about 0.5%

In itself...not a significant amount. But if you take the concept further and start putting caps not only on lawyers, but doctors, hospitals , insurance companies and drug companies...now you are talking real savings.

Government limits to jury awards. Yes.
Government limits to doctors fees. Yes
Government limits to drug companies profits. Yes
Government limits to insurance companies profits. Yes

The Tyron system blocks out the drop center of a wheel, so when a tire blows out, the wheel rim cannot come into contact with the road surface...steering, braking, and control are maintained. In a normal tire blowout, the wheel rim will contact the road surface, dig into the pavement, and then take the driver on a wild ride right or left depending on which steer (or front) tire blows out. That is why right steer blowouts end up in ditches off the side of the road (resulting in flips) and left steer tire blowouts cross the median generally into oncoming traffic. Tyron has been tested to the extreme by all the major tire companies and is used by police, fire, rapid responders, trucks, buses, etc. worldwide.
